These Terms of Use ("Terms") are an agreement between you and Soluna ("Soluna," "we," "us") governing your use of the Soluna app and this website (together, the "Service"). Please read them carefully.
1. Acceptance of these terms
By downloading, accessing, or using Soluna, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. If you are using Soluna on behalf of someone else, you confirm you are authorized to accept these Terms for them.
2. License to use Soluna
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to download and use Soluna on Apple devices that you own or control, for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, sublicense, or distribute the app except as permitted by applicable law.
3. Health and wellness disclaimer
Soluna is a general wellness and informational tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The sleep debt figures, energy curve, smart bedtime, habit suggestions, and any other content are estimates based on models of sleep and circadian rhythm, and are intended to help you reflect on your own patterns.
Always seek the advice of a physician or other qualified health provider with any questions about a medical condition, your sleep, or before making changes to your sleep, exercise, medication, or health routines. Never disregard or delay professional medical advice because of something you read in Soluna.
Do not use Soluna in any situation where inaccurate information could lead to injury — for example, do not rely on it to decide whether you are alert enough to drive or operate machinery. If you think you may have a medical emergency, contact your local emergency services immediately.
4. Apple Health and your data
With your permission, Soluna reads sleep and related health data from Apple Health to provide its features. This processing happens on your device, and Soluna does not collect or transmit that data. For details, see our Privacy Policy. You are responsible for the permissions you grant and can change them at any time in your device settings.
5. Purchases
Soluna is distributed through the Apple App Store, with no subscriptions or recurring charges. Any purchase you make is processed by Apple under its terms — we do not process or store your payment information, and Apple handles all billing, applicable taxes, and refunds. The terms shown to you by Apple at the time of download apply to that transaction.
6. Acceptable use
You agree not to misuse the Service. In particular, you will not attempt to disrupt or compromise the app, access it through unauthorized means, use it to violate any law, or interfere with another person's use of the Service.
7. Intellectual property
Soluna, including its name, design, visual identity, text, and software, is owned by us and protected by intellectual property laws. These Terms do not transfer any ownership to you. "Soluna" and our logo are our marks; other names and logos are the property of their respective owners.
8. Third-party services
The Service relies on third-party platforms, including the Apple App Store and Apple Health. Your use of those services is governed by their own terms and policies, and we are not responsible for them. Apple is not a party to these Terms and is not responsible for Soluna or its content.
9. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate it produces will be accurate for you.
10. Limitation of liability
To the fullest extent permitted by law, Soluna and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Where liability cannot be excluded, it is limited to the amount you paid us for the Service in the twelve months before the claim, or, where you paid nothing, to a nominal amount.
11. Termination
You may stop using Soluna at any time by deleting the app. We may suspend or end your access to the Service if you materially breach these Terms or if we discontinue the app. Sections that by their nature should survive termination — such as the disclaimers, intellectual property, and limitation of liability — will continue to apply.
12. Changes to the Service and these Terms
We may update the Service and these Terms from time to time. When we make material changes to the Terms, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Continuing to use Soluna after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Soluna is established, without regard to conflict-of-law rules. Nothing in these Terms limits any consumer-protection rights you may have that cannot be waived under the law where you live.
